Rule 6.2.1(2)(b) requires that maps and exhibits be prepared and signed by a <br />registered land surveyor, professional engineer, or other qualified person. <br />Please have the maps and exhibits signed in accordance with the Rule. It <br />would also be helpful to have larger maps in order to interpret the contour <br />lines, and features located on the mining and reclamation plans. <br />Response: The maps and exhibits have been signed by the party who prepared <br />them. We are also sending copies of the oversized maps as requested during <br />the pre-operation inspection. <br />"" 4. Exhibits A, B and N reference three legal descriptions of the proposed gravel <br />' pit. The legal description in Exhibit A states that the Tellier Gravel Pit is <br />located in the NE 1/4 of the NE 1/4 of Section 17. The project location map <br />depicts the pit in the NE 114 of the NW 114 of Section 17, and the warranty <br />deed included in Exhibit N references the SE 114 NW 1/4 of Section 17. Please <br />clarify this discrepancy and revise the exhibits accordingly. <br />Response: The legal description in Appendix A is in error. The mention of the <br />property in the heading of the Appendix A of the Warranty Deed as being in the <br />SE 1/4 of the NW 1/4 is in error. A careful reading of this deed shows that the <br />description of the property being conveyed to Luke Jay and Caroline Jean Tellier <br />is described, some six times, as being the NE 1/4 of the NW 1/4 of Section 17. <br />This is the tract of land on which this gravel pit is being proposed. The legal <br />description in Appendix A has been revised accordingly and copies of the Plat <br />maps have been added. A more detailed response to this matter is found in <br />revised Exhibit N. <br />5. During the pre-operation inspection held on 8/27198, two structures were <br />noted south of the permit area. These structures are within 200 feet of the <br />affected area, and must be included on Map # 2, to be in compliance with Rule <br />6.4.3(b). Please revise the map accordingly. <br />Response: The Applicant's response to this matter is found in Revised Exhibit <br />S. <br />~r 6. The operator indicates that a dewatering trench will be constructed in order <br />to expose and excavate the gravel deposit on the site. The dewatering trench <br />depicted on Map # 3 will be constructed on the south and west portions of the <br />pit. Please inform the Division if the dewatering trench will extend along the <br />high pressure gas line and the unnamed creek. <br />Response: Yes, a dewatering trench will be constructed along the north side of <br />the natural gas pipeline to dewater the area associated with the Phase I mining <br />block of this operation.
