~.. • <br />RESPONSES TO THE DMG ADEQUACY LETTER DATED 24 SEPTEMBER 1998. <br />DMG Concern: <br />1. As noted during the pre-0peration inspection, the public notice contained an <br />~~~,;,.~~~;,~ , incorrect comment period and date. Please send the Division a corrected <br />version of the public notice. <br />Response: Enclosed you will find a corrected copy of the public notice which <br />contains the information we were instructed to correct in the previous version. As <br />can be observed, this copy of the public notice been xeroxed from the Legal <br />Notices in the Steamboat Pilot newspaper, so this also serves as proof of <br />publication. <br />The Division received two commentlobjection letters during the public <br />comment period. The letters are attached for your reference. An informal <br />conference will be scheduled in the near future to obtain any additional <br />comments and identify and resolve issues if possible. <br />Response: The Division's letter identifying David and Janet Bradley as an <br />"adjacent landowner" is incorrect. The records of the Routt County Assessor's <br />Office indicate that they own no property within five miles of the proposed mine <br />site. <br />t'~. - 2. As required by Rule 1.6.2(1)(e), please provide proof of notices to all easement <br />1 -/ <br />holders that are within 200 feet of the boundary of the affected land. This <br />would include easement holders for the gas pipeline and any utility within 200 <br />feet of the permit boundary. A copy of the signed, certified mail return receipt <br />card is acceptable. Please note that a 41 day comment period will be required <br />if easement holders have not been previously notified. <br />Response: The natural gas utility was notified of this proposed operation as can <br />be observed in the attached letters which have been added to Revised Exhibit <br />C. Please observe that the Public Service Company of Colorado was sent a <br />letter via FAX on 5 January 1998 and that their response was sent to us under <br />the date of 6 January 1998. While this letter does not contain all of the <br />information required to be included in the Public Notice, the Applicant submits <br />that it contains significantly more operational details regarding this proposed <br />gravel pit than is found in the Public Notice and that it is sufficient to satisfy the <br />notification requirement. <br />Attached to this submittal are formal revised public notices sent to all of the utility <br />companies who hold easements within 200 feet of the affected land. Copies of <br />the certified mail receipts are attached to these letters and can be found at the <br />end of Revised Exhibit C. <br />1 <br />
