<br />EXHIBIT M <br />OTHER PERMITS AND LICENSES <br />The following permits, licenses or approvals are in the process of being sought: <br />-NPDES Permit -Colorado Department of Heath (Submitted) <br />-Access permit for Highway 6 -Colorado Department of Transportation and Eagle <br />County (Approved with revisions) <br />-County Zoning and Land Use Permit -Eagle County - (Approved with conditions) <br />-Private Railroad Crossing Permit -Union Pacific Railroad (Submitted) <br />-Air quality permits for crusher, cement plant and asphalt plant -Colorado Department of <br />Health & Environment, Air Pollution Control Division (Submitted) <br />-Migratory Bird Species Act - U.S. Fish and Wildlife Service* <br />The Migratory Bird Species Act requires a permit if the mating pair of red-tailed hawks are <br />disturbed from their nest. Their nest is located at the easterly end of the project, near phase 6. <br />The birds should not be disturbed by the mining activities until Phases 5 and 6. If the nest is still <br />active at that time, a permit with mitigation measures will be obtained from the U.S. Fish and <br />Wildlife Service. <br />
