SECTION E - IMPACTS AND RECLAMATION <br /> Further Land Development <br /> Most of the land development in the area is now subject <br /> to the Colorado Open Mining Land Reclamation Act of 1973 , <br /> which states at 92-36-5: <br /> "Preservation of Commercial Mineral Deposits for Extraction. <br /> (1) After July 1, 1973 , no board of county commissioners , <br /> governing body of any city and county, city or town, or <br /> other governmental authority which has control over zoning <br /> shall by zoning, rezoning, granting a variance , or other <br /> official action or inaction, permit the use of any area <br /> known to contain a commercial mineral deposit in a manner <br /> which would interfere with the present or future extraction <br /> of such deposit by an extractor. " <br /> Much of the area is included in the survey of commercial <br /> mineral deposits in the populous counties of Colorado, as <br /> stated in the State Geological Survey, Department of Natural <br /> Resources Special Publication 5-A, "Sand, Gravel and Qual <br /> Aggregate Resources Colorado, Front Range Counties , 1� 7 <br /> Under this constraint, therefore, further development in <br /> the area will require extraction of the proven existing mineral <br /> deposits as a first step . <br /> Conclusion <br /> The historic and recent land use in the subject area has <br /> been irrigated agricultural crop production in close proximity <br /> to flood potential from Cache La Poudre River. The Larimer <br /> County Commissioners have agreed to the applicants request to <br /> designate his area through zoning action as a mining area <br /> because of the flood hazard, thus prohibiting other urban uses , <br /> and also because of the above mentioned Colorado Open Mining <br /> Land Reclamation Act of 1973 as amended, as conservation-mining <br /> area for valuable and diminishing resources such as sand and <br /> gravel. <br /> As it seems logical that this already established "open" <br /> - Flood Plain - Mineral Extraction policy would continue, rein- <br /> forced by state policy (laws) , we believe that our mining and <br /> subsequent reclamation activities are in line and compatible <br /> with present and future land uses policies of the state and <br /> county. <br /> -5- <br />
