<br />• • ~Op <br />3.2. Licensee shall limit equipment height operating under the transmission line to <br />fourteen (14) feet, where the terrain has not been disturbed. Equipment exceeding <br />fourteen (l4) feet in height may be operated under the line ONLY where prior excavation <br />of the terrain has been performed to a minimum depth equal to the difference between <br />the the equipment height and fourteen (14) feet. {Example: Equipment eighteen (IH) feet <br />in height requires that four (4) feet of excavation be performed prior to working under <br />the transmission line.} <br />3.3 All equipment working under the transmission line must be grounded. <br />3.4 Licensee shall ensure that all employees working in the right-of-way of the <br />transmission line are qualified as defined per latest O.S.H.A. requirements. <br />3.5 Licensee shall provide Licensor unimpeded access for maintenance and operations <br />of the transmission line facility. Access roads shall not to exceed 12~ in grade to <br />transmission line structures. <br />3.6 Licensee shall not perform any excavation within 50 feet of any transmission line <br />structure. <br />4. This license is issued subject to any prior licenses or leases granted by the <br />Licensor for facilities of other parties. <br />Licensor reserves the right to license others to install pipes, conduits or ducts in, <br />on, under and along the premises herein described, provided that same shall not interfere <br />unreasonably with the license herein granted. <br />5. Protective measures which may be taken by Licensee shall in no way cause <br />reduction of electrical clearance andlor damage facilities of Licensor, and if such damage occurs, <br />Licensee shall take immediate steps to correct the condition and will compensate Licensor for <br />any damages. Should Licensee fail to so correct and compensate, Licensor may declare this <br />license terminated pursuant to paragraph 8, thirty (30) days after notice of its intent to do so is <br />mailed to Licensee. <br />6. Licensee shall indemnify and save and hold harmless the Licensor against all <br />claims and liability for damages, loss or expenses, including reasonable attorney's fees, caused <br />by any injury or death to any person or damage to property, if the same shall in arty way be <br />connected with or result from the use of the said premises by Licensee, unless created and <br />caused by the sole negligence of Licensor. <br />7. Licensee agrees to reimburse Licensor any and all costs, including reasonable <br />
