.~ <br />Opp <br />LICENSE %~~~ w ~-.~~~ <br />TSL-3516-96005 ~7.] - ~j~~ - ~-c,(', <br />THIS LLCENSE, rnade this 9th day of July, 1996, by and between TRl-STATE <br />GENERATION AND TRANSMISSION ASSOCIATION, INC., a Colorado cooperative <br />corporation of Adams County, Colorado, hereinafter called "Licensor," and WF,STERN <br />GRAVEL, INC. hereinafter called "Licensee." <br />W{TNESSETH: <br />WHEREAS, Licensor owns an easement for electric transmission lines in the Southwest <br />Quarter of Section 18, Township 49 North, Range 9 West of the New Mexico Principal <br />Meridian in Montrose County. State of Colorado. <br />'the easement area being one hundred feet wide, with fifty feet each side of the center <br />line of the transmission line. <br />WIIEREAS, Licensee has requested permission to operate, maintain and reclaim a gravel <br />mining operation across said casement: <br />NOW THEREFORE, in consideration of the sum of One Dollar ($l .00), the rea;ipt of <br />which is hereby acknowledged, Licensor does hereby gran[ to Licensee a license to locate its <br />facility as shown on Exhibit "A", attached hereto and made a part hereof subject to the following <br />terms and conditions, to wit: <br />1. No future change of the gravel mining operation boundaries within the descrihed <br />easerttent area shall be made without written approval in advance from the Licensor. Licensee <br />shall also provide Licensor with a copy of its approved mining plan or permit. Said copies to <br />be mailed to the Licensor's Land and Land Rights Department, P.O. Box 33695, Denver <br />Colorado 80233. <br />2. It is undersloud and agreed that the Licensor is the owner of only aright-of-way <br />easement in the above described properly fur the construction, operation, maintenance, and <br />reconstruction of an electric transmission line, and that the Licensee, its successors and assigns, <br />should obtain a conveyance from the fee owners of the property. <br />3. Licensor requires, and Licensee accepts, the following special conditions placed <br />upon this License: <br />3. t Excavation shall be as per mining plan ur Exhibit "A", attached. <br />
