While no permits for <br />the settling ponds were issued by the County, the County Land Use Code does not <br />• preclude this ]and use under this circumstance. <br />Based on our telephone conversation this morning, water quality monitoring is being <br />addressed through compliance with the Water Dischazge permit you've obtained from the <br />State Health Department. Due to the small size of the dams and the low volume of water <br />impounded, no approval was required or obtained from the State Engineer, though the <br />dams were designed and certified by a professional engineer.
