STATEMENT OF CERTIFICATION

I, David J. Brent, a Registered Engineer and Land Surveyor in the State of
Colorado, holding Certificate No. 13290, hereby certify that on June 10, 1981,
I performed an inspection and a survey of the above identified sedimentation
pond facility, and that with subsequent compilation of field survey
information have found said facility to be in general conformance with the
requirements of Section 4.05.6, Regulations of the Colorado Mined Land
Reclamation Board for Coal Mining, and with the certified design plans of
Rocky Mountain Geotechnical, Inc., dated September 13, 1982. The sediment and
runoff storage capacity of the facility equals or exceeds the requirements of
Section 4.05.6 of CMLRB Regulations.
