<br />Conservation District. It is no[ Center Soil Conservation Service, nor is it the United Slates Soil Conservation <br />District (both of which incorrect names are included in this application). I noticed N. Tracy Miller's signature as <br />recipient of your first SCD notice, though he works For the USDA Natural Resources Conservation Service, not the <br />SCD. The later notice you sent was addressed to "Soil Conservation" and signed for by Deanna Brown, a secretary <br />for both the SCD and the NRCS. Due solely to her signature and being a SCD employee, I am considering [his <br />second notice to be adequate. Please note that we do not require notification to the NRCS, but do require one to the <br />local SCD. <br />Exhibit S -Permanent Man-made Structures <br />Many references have been made in the preceding paragraphs to structures within the proposed permit area <br />boundary or within 200 feet of such boundary. This exhibit states that there are no such structures. Please ensure <br />that elsewhere in your response letter, and under this exhibit also, you identify all structures as required. These <br />items are to be depicted on the maps also. If your activity is to occur within 200 feet of land or structure which <br />another party has o~mership of or other legal interest in, you may have to either obtain a damage agreement or <br />provide an engineering analysis showing there will be no damage. Please respond with the necessary information. <br />Addendum -Posted Notice <br />Your affidavit appears adequate. My question is in regard to the 4/7/98 date by your signature. Is the Notice still <br />posted at the entrance, and is it still legible? <br />Additional Items <br />You and 1 have discussed modifying the language in your public notice in the newspaper. [f you have received any <br />copies of this notice, please send me a clipping so 1 may ensure there are no fatal typographical ertors (requiring it <br />to be restarted) and so I may know the duration of the public comment period. After the fourth publication, please <br />send me a notarized affidavit from the publisher. <br />I have received one letter of comment from an adjoining landowner, Mr. Walter Baker, a copy of whose letter I am <br />attaching hereto. The letter does not express any adverse comment, and I will respond to him in writing. <br />You are aware that all owners of property (land, easements, rights-0f-way, and structures) must be individually <br />notified about this application. The language to include in the notice is the same as that used in the published <br />notice. Please ensure that all such parties are notified (including any additional parties which were discussed in my <br />paragraph seven under Exhibit C), and proof of all such notices sent to this office before the decision date. <br />You have stated that the original, complete application is on file at the county clerk and recorder. While the <br />application is in review, you must ensure that all additional materials subsequently becoming part of the file also be <br />placed on file. Therefore, please place this letter to you, plus all written responses to me, on file at the clerk and <br />recorder, and provide to me a receipt of your prompt filing. This must be done for all additional correspondence <br />and materials. <br />The decision date is currently set for 4/25/00. Prior to that time I will contact you to schedule apre-operation <br />inspection of the site.
