Long <br />Division D~wuor <br />1 have finished my review of the above-named application, and have noted a number of things which must be <br />clarified or answered before the Division's decision date. I have arranged these questions below in the order of the <br />application item or exhibit to which they pertain. Please respond to each item, by labelling and arranging your <br />answers in the same manner. Items which are not listed below are considered to be adequate at this time. <br />Application Item #3 -Permitted Acreage <br />The information provided in the application here states that your permit area is for "80 acres." This becomes a <br />question since [here are several other possible acreage figures included elsewhere in the application: 1) details <br />shoten on the large maps (Exhibits C and F) included with the application state two slightly different amounts <br />(79.17 acres and77.65 acres), and under pazagraph E (of Exhibit D) you include the acreages amounts of 77, and <br />77.65, and 75.65 acres. Some of these discrepancies may be due to accounting for various easements, but overall <br />they need to be clarified. Please provide the total acreage of the area to be included in the permit. (I will mention <br />more about the acreage question below.) <br />Anplication Item #6 -Names of Owners of Recorded Easements <br />You state that there are no easements lying within the permitted acreage that are owned by parties other than Kenny <br />and Dana Smith. The maps included in Exhibits C and F show a feature labelled as "McCormick Ditch, <br />Easement/Right of Way." If this is an easement for a stmcture or feature that is owned by another entity, please <br />provide the name of that entity, for this application item and for Exhibit O. (I will mention more about onsite and <br />adjacent structures below.) <br />Exhibit A - Leeal Descriesion <br />The legal description included here shows the wrong township and no prime meridian. The legal description of the <br />site is included in several other places in [his application, and all match except this one. The exhibit should be <br />revised to read: "West l/2 of Southwest l/4 of Section 35, Township 41 North, Range 7 East, New Mexico (or <br />loth) prime meridian." <br />R~CEI~/Fn <br />Exhibit C -Pre-mining and Mining Plan Maw <br />1 have numerous questions about these maps, which I will detail in the following paragraphs.
