The limitation clearly applies to the mining properties and <br /> concern ores from other sites might be brought to extraction dumps <br /> for purposes of up-grading ore prior to transport to Mill for milling. <br />' The permit issued on August 6, 1985 does not appear to have <br /> application to Gold Hill Mill inasmuch as it focuses upon mining and <br />' milling in the Who Do, White Cloud and Wynona sites with the only <br />restriction to be the use of existing north access onto Sunshine <br /> Canyon Road and the approval based upon issuance of a limited access <br />' permit by Colorado MLRB. <br /> It is clear at least the Mill permitting is somewhat confused by <br /> use of the names Gold Hill Ventures Qoint venture Mi Vida and <br />' Cosmos) and Gold Hill Ventures Limited Partnership (unformed <br /> association with Mi Vida as general partner and Cosmos and Fraser as <br /> proposed limited partners). <br />' <br /> In addition, the permit of August 6, 1985 appears clearly to <br /> apply to the mine, whereas permit issued on November 12, 1985 is a <br />' remodeling permit which describes a milling accessory which is <br /> specifically related to underground mining and surface handling of the <br /> ore after extraction. <br /> <br /> Our research now has revealed Mark Steen communicated to <br /> Mr. Stephen Ellis with the Zoning Administration of Boulder County <br /> Planning Department by letter January 2, 1985. This communication <br />' is from Gold Hill Ventures (Mi Vida/Cosmos). In this letter, among <br /> other things, Mr. Steen confirms the proposed location of a milling <br /> site to be near the Wynona and White Cloud mines. He further states <br />' all of the milling operations will be on property located within Boulder <br /> County Forestry Zoning District. <br />Ellis replied to Steen on January 9 stating, among other things, <br />that the mill site is an allowable use by right within the Forestry <br />' Zoning District. <br />Steen again communicated with Ellis by letter on letterhead of <br />Gold Hill Ventures (Mi Vida/Cosmos) July 30, 1985. In this letter he <br />again refers to the proposed mill site and describes the claims within <br />which the site is located. He then states the mill "will be used <br />exclusively to process ore that we own, the mill complex will not be <br />operated as a public or custom facility and will not process ores on a <br />toll basis for other mining operations." <br /> <br />
