Letter of Agreement <br />between the <br />Colorado Mined Land Reclamation Division <br />and <br />Pueblo Coal, Inc. <br />I. Introduction <br />Pueblo Coal Inc. (the operator) and the Colorado Division of Mined Land <br />Reclamation (the Division) hereby enter into the following agreement in regard <br />to continuation of the review time period for renewal of Permit C-82-054 for <br />the Carbon Junction Mine beyond the 180 day timeframe specified in Section <br />119(2) of the Colorado Surface Coal Mining Reclamation Act (Act). Violation <br />of the timetables or conditions set forth below will constitute sufficient <br />reason for the Division to go forward with a proposed decision to deny the <br />renewal application or the applicant to petition the Mined Land Reclamation <br />Board (the Board) fora hearing on the issues. <br />II. Conditions ~ ~~ <br /> ~I <br />A. By July 1, 1989, the operator will submit to the Division a copy of <br /> the court order or other properly notarized legal documents which <br /> insure that the bankruptcy court will make funds available as <br /> necessary for the operator to perform maintenance and monitoring at <br /> the Carbon Junction Mine as required by the pernit and regulations <br /> while Pueblo Coal, Inc. is in bankruptcy. <br /> nom,. tc/ /=r 3-9 <br />C.
