BANTA, Director <br />May 26, 1989 <br />Mr. Jim Hendricks <br />Pueblo Coal, Inc. <br />278 Sawyer Drive, Suite lA <br />Durango, Colorado 81301 <br />RE: Permit Renewal No. 1 <br />File: C-82-054 <br />Dear Mr. Hendricks: <br />As you are aware, Permit No. C-82-054 for the Carbon Junction Mine has <br />expired, and, due to a number of informational deficiencies previously <br />identified, the Division is unable to issue a proposed decision to approve a <br />permit renewal at this time. Pueblo Coal, Inc. has waived their right to a <br />decision within the 180 day timeframe specified in Section 119(2) of the Act, <br />and has requested an extension of the renewal review period. The primary <br />reason given for requesting the extension is that Pueblo Coal, Inc. is in <br />Chapter 11 Bankruptcy and thus not able to perform certain work required to <br />obtain a permit renewal. <br />At this point, there are three options available to Pueblo Coal, Inc., with <br />regard to the Carbon Junction Coal Mine and the Colorado Surface Coal Mining <br />Reclamation Act. One option, which you have discussed with the staff, is a <br />continuation of the renewal review period, with certain conditions and <br />specific timetables for continuation of the review set forth in a formal, <br />written agreement. A second option would be for Pueblo Coal, Inc. to accept <br />reclamation only permit for the Carbon Junction Mine, with reclamation to <br />begin next spring. The third option would be to accept a Permit denial <br />decision from the Division. Under this option, the Division would then <br />proceed with bond forfeiture and reclamation. <br />Since you have requested a continuation of the review, the Division has <br />drafted an agreement specifying timetables and conditions which must be met. <br />Two copies of the agreement are enclosed, both signed by Fred Banta, <br />Division Director. If you concur with the agreement, both copies will need to <br />be signed by an authorized representative of Pueblo Coal Company, Inc. and one <br />signed copy will need to be returned to the Division. <br />Please contact me if you have any questions. <br />Sincerel <br />~'\ <br />Ftichael B.
