• Exhibit G -Water Information (continued) <br />the land to another rancher and the unnamed drainage flows have been restored to their original <br />channel. It is likely that the temporary wetland may dry up due to these changes. B&B cannot be <br />responsible for any changes that the private landowner makes on her land downstream of the permit <br />area. B&B solely commits to maintaining the current water patterns through the site, namely, the <br />flows in the unnamed drainage and the perennial spring. <br />Due to concerns raised by the Corps of Engineers and the Division of Wildlife, the unnamed <br />drainage and Spring Creek were analyzed for qualification as jurisdictional waters of the United <br />States, wetlands and riparian habitat. The study was performed by Mike Savage of Savage and <br />Savage. The entire report of the investigation is included in Appendix B. Overall, it was determined <br />that the parameters required for a jurisdictional wetland do exist in the unnamed drainage, although <br />the width is small due to lack of water a short distance on either side of the channel. The total area <br />of the wetland is less than 0.5 acres. Wetlands of this size are not regulated and do not require <br />• mitigation according to federal regulations. Although some riparian plants were found, conditions <br />were Lr4I found for true riparian habitat, as explained in the Savage report. <br />In spite of these findings, B&B has decided on avoidance of this area and it has been eliminated <br />from the permit area. It will not be disturbed. B&B will leave a buffer of 45 to 100 feet in width to <br />protect the channel and its surrounding vegetation. Map Exhibits C-I and C-2 show the plan view <br />of this buffer area. Across-section of the buffer is given in the earlier section on the mining and <br />reclamation plan. <br />Spring Creek Investigations jor Wetlands & Riparian Areas <br />Investigations of Spring Creek showed no springs such as those found in the unnamed drainage. <br />Soil borings showed dry conditions although some cottonwoods and other plants requiring above <br />average moisture were found in the channel in small percentages. The landowner has stated that no <br />water has flowed in this drainage to her knowledge in many years. Evaluation of the historical <br />• watershed and the USGS topo maps has shown that the Countv airport construction and possibly <br />Carol Ann Permit CDMG Application 41 <br />
