We are submitting this letter to respond to all of their concerns. <br />Mike Sherman and Mike Babler of DOW and Lynn Mayer of L.G. Everist, Inc., met to assess any <br />wildlife concerns at the Lohmann property on June 7. <br />Mr. Babler submitted comments to Weld County on June 11. Mr. Babler recommended that a <br />small prairie dog town on the site be relocated. Lynn Mayer researched the possibilities of <br />relocation with Mr. Sherman's help, and found out that there are no sites in Weld County accepting <br />prairie dogs at this time. Please see the attached June 19 letter from L.G. Everist to Weld County <br />Planning for more details. <br />A recommendation of cone-hundred (100) foot setback from the ditch which runs along the south <br />and east sides of the mining operation boundary is suggested in Mr. Sherman's letter. L.G. Everist <br />has already taken precauticns in the mining plans to ensure that the ditch will not be disturbed. <br />First, the ditch which runs along the south and east sides of the proposed mining limits is actually <br />outside of the permitted area. Second, twenty-five (25) foot setbacks are already included in our <br />mining plan. Third, we will be lining the site with a clay liner in the northwestern section and a <br />slurry wall in the eastern section so that it can be reclaimed for water storage. These two liners will <br />be constructed inside the mining limits, further insulating the ditch from any disturbance. <br />Therefore, the 100-foot setback recommendation is not necessary, as the above mentioned <br />precautions already ensure that the ditch and existing vegetation will not be disturbed. <br />No wetland or riparian habitat will be disturbed, including non-jurisdictional wetlands. The Army <br />Corps of Engineers accepted and acknowledged the determination by Wright Water Engineers that <br />"there are no wetlands or other waters of the U.S. on this site." The February 27 letter from the <br />Corps to Wright Water Engineers was included in the application materials.
