Further, the Board moved <br />that enough public money has been spent reviewing the reclama- <br />tion aspects of the Streeter Fill; and that, with the expendi- <br />ture of absolute minimum review time, the construction tech- <br />niques used on the Streeter Fill automatically be deemed <br />appropriate as standard practice for the Streeter Fill if and <br />when the regulations evolve to that point." <br />September 10, 1982 Colowyo received from the Director of OSM approval of the <br />Experimental Practice application. OSM's review determined <br />that the "request meets the requirements of human health and <br />safety and environmental protection required by the Act". <br />November 4, 1982 Colowyo received from the MLRD the Coal Mining Permit Number <br />C-019-81. _. <br />February 18, 1983 Colowyo received from the OSM Coal Mining Permit Number CO-0015 <br />which incorporates the Colorado Permit Number C-019-81. <br />In light of the Board's Decision to deem the Streeter Fill construction <br />techniques appropriate as standard practice for the Streeter Fill when the regula- <br />tions have evolved to that point, the following chronology of regulatory changes <br />• affecting the status of the Streeter Fill are offered for your review. <br />The regulatory changes provide an historical account of the changes in <br />excess spoil regulation changes made by OSM, and development of the Colorado Perm- <br />anent Regulatory Program. <br />December 13, 1977 Publication of Federal Register Notice (42 FR 62639-62716), <br />the Interim SMCRA regulations with an implementation date <br />appropriate for Colowyo of May 3, 1978. The regulation con- <br />taining design criteria for excess spoil fills is Section <br />715.15 Disposal of spoil and waste materials in areas other <br />than the mine workings or excavations. <br />March 13, 1979 Publication in the Federal Register the OSM Permanent Regula- <br />tory Program (44 FR 15311-15463). These regulations in Sec- <br />tions 816.71 and 816.72 contain both design criteria and per- <br />formance standards for the construction of excess spoil/valley <br />fills. <br />February 29, 1980 State of Colorado submitted to OSM its proposed permanent regu- <br />latory program under SMCRA. <br />
