During passage of the 70-year, 24-hour storm the spillway does not
discherBe sediment downstream nor is there any flow through the emergency spillway. The
pond will be a permanent structure after mining and therefore has been designed to safely
pass the flow from the 700-year, 24-hour precipitation event. The embankment is
constructed to be stable and provide adequate freeboard. Therefore, based on the design,
this structure complies with the appropriate regulations for a sedimentation structure.
Peabody Coal Company will periodically inspect this structure for sediment storage,
structural integrity and hazardous conditions. Maintenance end remedial work will be
performed in accordance with the approved mine permit.
18
