During passage of the 70-year, 24-hour storm the spillway does not <br />discherBe sediment downstream nor is there any flow through the emergency spillway. The <br />pond will be a permanent structure after mining and therefore has been designed to safely <br />pass the flow from the 700-year, 24-hour precipitation event. The embankment is <br />constructed to be stable and provide adequate freeboard. Therefore, based on the design, <br />this structure complies with the appropriate regulations for a sedimentation structure. <br />Peabody Coal Company will periodically inspect this structure for sediment storage, <br />structural integrity and hazardous conditions. Maintenance end remedial work will be <br />performed in accordance with the approved mine permit. <br />18 <br />
