Case No. 94CW036, Findings of Fact, Conclusions of Law and <br />Decre¢ of the Court Approving Absolute and Conditional Ground <br />Water Rights, Plan of Augmentation and for Change of Water Rights, <br />Application of the City of Black Hawk, <br />Page 8 <br />Applicant's depletions will be replaced with water from the sources described in paragraph 17, below. <br />This plan will fully augment all out-of-priority depletions. Any such replacements shall be in <br />accordance with the terms and conditions of this decree. The following terms and conditions, and <br />those found in paragraph 34, below, will prevent injury to other water users: <br />14.a. Withdrawals from wells will be metered and recorded. <br />14.6. Direct diversions of surface water will be measured and recorded. <br />14.c. Applicant will account on a daily basis for out-of-priority depletions and <br />replacements and will file a monthly accounting report with the Division Engineer and the Water <br />Commissioner. <br />14.d. When Objector Public Service Company's exchange decreed in Case No. <br />95CW157 is a calling right, or would be able to operate but for Black Hawk's out-of-priority <br />depletions, Black Hawk shall make replacements above the Farmers' High Line diversion dam on <br />Clear Creek for its out-of-priority depletions that occur upstream of the Farmers' High Line dam. <br />15.
