Uses of Water: The water will be used for all municipal purposes, <br />including domestic, irrigation, industrial, commercial, fire protection, stockwatering, recreation, <br />piscatorial, storage and all other municipal purposes. The water will also be used by exchange for the <br />foregoing purposes, for replacement, and for augmentation purposes. Additionally, the Applicant has <br />requested a decree for the right to use, reuse, successively use and dispose of, by sale, exchange or <br />otherwise to extinction all water lawfully diverted and/or stored in this case. <br />8.f. Date of Appropriation: March 16, 1993. <br />CONCLUSIONS OF LAW <br />9. The Court incorporates the foregoing Findings of Fact to the extent that these <br />may constitute conclusions of law. <br />10. This Court has jurisdiction over all persons who could have appeared but did <br />not and over all parties who did appear. <br />11. The Court determines, as a matter of law, that the application for the <br />conditional direct flow water right proposed by the Applicant meets the standards described in C.R.S. <br />§ 37-92-305, and other applicable provisions ofColorado law, and will not result in any injury to any <br />owner of or person entitled to use water under a vested water right or a decreed conditional right, if <br />operated in accordance with this decree. <br />12. This decree is authorized by law and is within the jurisdiction of this Court. <br />C.R.S. 37-92-101 et seg., as amended. <br />13. Applicant has complied with all requirements and met all standards and <br />burdens of proof, including but not limited to C.R.S. §§ 37-92-302, 37-92-304, and 37-92-305 as <br />amended, to adjudicate its conditional direct flow water right decreed herein. <br />14. Review of determinations made by the Division Engineer in the administration <br />of the accounting procedure and forms associated with this decree is a "water matter" over which this <br />Court has exclusive jurisdiction under C.R.S. § 37-92-101 et seq. <br />
