Timely and adequate notice of the application and amended application was <br />published as required by law, and the Court has jurisdiction over the subject matter ofthis proceeding <br />and over all persons and water rights affected thereby, whether they have appeared or not. The time <br />for filing statements of opposition has expired. <br />6. The following parties have entered into stipulations with the Applicant on the <br />basis that those parties will not further oppose entry of a decree herein: <br />6.a. The State Engineer and Division Engineer for Water Division No. 1; <br />6.b. The City of Arvada; <br />6.c. The Ciry of Westminster; <br />6.d. The City of Thornton <br />7. The Applicant is a Colorado municipality. It owns and operates a municipal <br />water system and provides water service to the area served thereby. <br />right: <br />8. The Applicant seeks a decree for the following conditional direct flow water <br />8.a. Structure: City of Black Hawk Effluent Diversion. <br />8.6. Location of Structure: The diversion points shall be located at the <br />outfall of the Black Hawk-Central City Sanitation District Wastewater Treatment Plant presently <br />located in the SEY<, Section 7, Township 3 South, Range 72 West of the 6th P.M., Gilpin County, <br />Colorado, and at its proposed new location in Section 26, Township 3 South, Range 72 West, at a <br />point 1,600 feet east of West section line of Section 26, and 2,] 00 feet north ofthe South section line <br />of Section 26. <br />S.c. Source of Water: Effluent from the Black Hawk-Central City <br />Sanitation District Wastewater Treatment Plant, including, but not limited to, City of Black Hawk and <br />Central City municipal return flows which contain diverted and/or stored surface water from the <br />South Platte River and its tributaries, ground water from the alluvium ofthe South Platte River and <br />its tributaries, and West Slope water, nontributary water, and developed water, if any. <br />S.d.
