Case No. 92-C W-059, Findings of Fact, Conclusions of Law and <br />Decree of the Court Approving Conditional Appropriative Rights of <br />Substitution and Exchange, Application of The City of Black Hawk, <br />Page 9 <br />Applicant shall be entitled to fully consume such water by direct use, storage and subsequent release, <br />reuse, successive use, further exchange and disposition. <br />21. Place of Use: The claimed place of use is the service area of the City of Black <br />Hawk as it presently exists and as it may exist in the future and any location capable of service from <br />the exchange-to points. <br />CONCLUSIONS OF LAW <br />22. The Court incorporates the foregoing Findings of Fact to the extent that these <br />may constitute conclusions of law. <br />23. This Court has jurisdiction over all persons who could have appeared but did <br />not and over all parties who did appear. <br />24. The Court determines as a matter of law, that the application for conditional <br />appropriative rights of substitution and exchange proposed by the Applicant meets the standards <br />described in C.R.S. § 37-92-305, and other applicable provisions ofColorado law, and will not result <br />in any injury to any owner of or person entitled to use water under a vested water right or a decreed <br />conditional right, if operated in accordance with this decree. <br />25. This decree is authorized by law and is within the jurisdiction of this Court. <br />C.R.S. § 37-92-]Ol et seq., as amended. <br />26. Applicant has complied with all requirements and met all standards and <br />burdens of proof, including but not limited to C.R.S. § § 37-92-302, 37-92-304, 37-92-305, 37-80- <br />120, and 37-83-104, to adjudicate its conditional appropriative rights of substitution and exchange <br />decreed herein. <br />ORDER. JUDGMENT AND DECREE <br />Based on the foregoing Findings of Fact and Conclusions of Law, it is hereby adjudged, <br />ordered and decreed that: <br />27. Each of the Findings of Fact and each of the Conclusions of Law set forth <br />above is incorporated herein by this reference. <br />
