Place of Use: The claimed place of use is the service area of the City of Black Hawk as it presently exists and as it may exist in the future and any location capable of service from the exchange-to points. CONCLUSIONS OF LAW 22. The Court incorporates the foregoing Findings of Fact to the extent that these may constitute conclusions of law. 23. This Court has jurisdiction over all persons who could have appeared but did not and over all parties who did appear. 24. The Court determines as a matter of law, that the application for conditional appropriative rights of substitution and exchange proposed by the Applicant meets the standards described in C.R.S. § 37-92-305, and other applicable provisions ofColorado law, and will not result in any injury to any owner of or person entitled to use water under a vested water right or a decreed conditional right, if operated in accordance with this decree. 25. This decree is authorized by law and is within the jurisdiction of this Court. C.R.S. § 37-92-]Ol et seq., as amended. 26. Applicant has complied with all requirements and met all standards and burdens of proof, including but not limited to C.R.S. § § 37-92-302, 37-92-304, 37-92-305, 37-80- 120, and 37-83-104, to adjudicate its conditional appropriative rights of substitution and exchange decreed herein. ORDER. JUDGMENT AND DECREE Based on the foregoing Findings of Fact and Conclusions of Law, it is hereby adjudged, ordered and decreed that: 27.
