<br />Joseph Dorris, Operator <br />Crystal Jack Plan of Operations -June 30, 2005 <br />E. Fish and Wildlife. <br />FS Clarification/Revision: <br />If the operator camps overnight, all foodstuffs will be properly contained and located to minimize <br />conflicts with wildlife, especially bears. Food items should be stored in a bear-proof container away <br />from any tenting or camping sites. <br />• In an active northern goshawk nest becomes known within the project azea, standard mitigation <br />measures would be implemented to protect birds from human-caused impacts. This would prohibit use <br />of mechanized equipment between March I and September 30 of each calendaz year within a 600-foot <br />radius (or within 30 acres) of the nest site. The operator would still be allowed to hand dig during this <br />time. <br />F. Cultural Resources. <br />FS Clarification/Revision: <br />• If a previously unlmown site is discovered by either the opemtor or the Forest Service, mining <br />operations that could impact the new site would stop immediately until the site is evaluated by the <br />Forest Service and any needed mitigation measures aze developed. <br />• If new proposed dig sites are proposed that aze outside the project area, additional Heritage Resource <br />surveys, documentation and OAHP/SHPO concurrence would be required. <br />G. Hazardous Substances. <br />FS Clarification/Revision: <br />• Storage and use of hazazdous materials or explosives is not authorized. <br />• No chemicals or additives may be used in water used for washing minerals on site. Any fuels, <br />antifreeze, solvents or potential hazazdous materials must be properly stored to contain any leaks, and <br />will be placed at least 100 feet away any perennial, intermittent, and ephemeral drainages, Limit <br />refueling to designated areas. <br />• The operator will use spill pads when pouring fuel or other petroleum products into tanks or other <br />containers, to contain any spillage before it reaches the soil or water. <br />• In the event of a petroleum (gas, diesel, oil, etc.) spill or other hazardous material spill onto the sofa of <br />the claim, immediately contact the National Response Center at 1-800-424-8802, Pazk/Teller County <br />Sheriff and the Forest Service Office in Fairplay. If hazardous substances aze spilled on a federal, state <br />or county roadway contact the Colorado State Patrol. All hazardous material spills will be disposed of <br />according to Colorado State Hazmat disposal guidelines. <br />• No dumping of gray water is permitted in accordance with the Colorado Revised Statutes. <br />H. Reclamation: <br />FS Clarificatfon/Revision: <br />Reclamation (general): <br />Continual reclamation will continue throughout the mining season. The claimant will take measures [o <br />prevent or control onsite and off-site damage to NFS land resources including (36 CFR 228.8 g): <br />• Control of erosion and landslides from temporary access roads and dig sites <br />• Control of water mnoff <br />• Isolation, removal or control of toxic materials <br />Annual (end-of-season) reclamation will include: <br />• Removal of all equipment and trash from mining claim <br />• Seed topsoil piles with nafive seed and/or monitor spoil piles for erosion problems. <br />• Recontouring and replacement of topsoil in disturbed sites where mining operations are complete <br />• Revegetation of all recontoured areas <br />• Annual reclamation will be completed by October 31 of each year. <br />Final reclamation will include: <br />• Removal of all equipment and trash from mining claim <br />• Recontouting and replacement of topsoil at all disturbed sites (including dig sites and all temporary <br />access roads) <br />
