General Limitations <br />The following limitations apply to all disdtarge roveriod by this permit: <br />1. Stormwatcr discharge from the mining operation shall not muse or threaten to muse pollution, <br />romamination or degradation of any State waters. <br />2. Bulk storage structures for petrokrun products aril other chonicals shall have adequate protection so as to <br />romain all spills and presrnt any spilled material from emtring State waters. <br />3. No chemicals are ra be added to the discharge unless permission for tlu use of a specific chemiro! is granted <br />by the Division. In granting the use of such chemicals, special ronditions and monitoring may be addressed <br />by separate letter. <br />4. All drschargcrs must romply with the lawful requirements of roumie, drainage districts and other state or <br />local agencie regarding any discharges of stormwater to storm drain systems or other water rourse under <br />their jurisdiction. <br />B. SWMP Requirements <br />The SWMP (see Section V/1, above) shall be prepared in accordance with good engineering practices. The main <br />objective of the plan shall be to idem~ Best Managemetu Practices (BMPs) which, when implememed, will meet <br />the terms and ronditions of this permit. <br />• Submittal of the SWMP is not auto»wtirnlly required under this permit. However, du Division reserve the right to <br />require submittal upon requet, and to review the SWMP and require additional measures to prevent and control <br />pollution. It is tlu Division's imem to request submission of such reports on a selective basis. <br />The following ronditioru must bt met to ao5ieve rompliance with this permit: <br />Certifieatwn of SWMP Compkhon and Implementation: For actiNe mining operations ezlsting ors October <br />1, 1992, as soon as possible but no later than the anniviersary date of their Mined Land Reclamation permit <br />that jolts between July 1, 1993 and June 30, 1994, the permittee shall have implemented and be in <br />rompliance with their SWMP. (See Pats LD.3 of the permit jar the cert~aation language.) The certification <br />date for SWMP implementation has been roordinated with the anniversary date ojthe reclamation permit to <br />facilitate the review by GDMG and to spread out the potemial impact on the GDMG. <br />For new aetlve jaeilitits (beginning operations after October 1, 1992), and for alI other active jacilitie <br />applying after July 1, 1993, the SWMP shall be prepared prior to applying for roverage under the general <br />permit. <br />For inaetivt mining operations applying before July 1, 1994, the permittte shill have implememed and be in <br />rompliance with their SWMP as soon as possible but no later than July 1, 1994. For those applying afer <br />July 1, 1994, the SWMP shall be prepared and rmplanemed prior to applying jar roverage under the general <br />permit. <br />2. Signatory Rtgttinmtnts: The plan shall be signed in acrordance with Parr LD.9 of the permit. <br />3. SWMP Revlew/Changes: Upon review of the SWMP, the Division may notify the permittee at any time that <br />. the plan does not meet one or more of the minimum requirements of this parr. After such not cation, the <br />permittee will make changes to the plan. Unless otherwise provided by the Division, the permittee has 30 <br />days after such rwtijiaation to both make the ucrssary changer to the plan and to implement them. <br />
