PART II <br />Page 15 <br />Permit NO. COR-040000 <br />A. MANAGEMENT REQUIREMENTS (wnt.) <br />• Any discharge to the waters of the State from a point source other than specifically authorized by this penait is prohibited. <br />The Division must be notified in writing on the addition of any outfalls. <br />2. Stxcial Notifications - Definitiore <br />a. Spill: An uaintmtioml release of solid or liquid materiai which may cause pollution of state waters. <br />b. Upset: An exceptional iacidmt in which Were is tmintmtioml and temporary noncompliance with permit effluent <br />limitations because of factors beyond We reasonable control of We permittee. An upset does sot include <br />mncoarpliance to Wa extent caused by operational error, improperly designed treatment facilities, inadequate <br />treatment facilities, lack of preventative maintenance, or careless or improper operation. <br />Noncompliance Notification <br />a: If, for any reason, We peratittx dose not comply wild or will be unable to comply wild any discharge limitations, <br />standards or permit regtirements specified in this permit, We permittee shall, at a minimum, provide We Water <br />Quality Control Division and EPA wild We following information: <br />I) A description of We discharge and tense of noncompliance; <br />2) The period of aoncomplience, including exact dates and times and/or We anticipated time when the discharge <br />will return to compliance; and <br />3) Steps being taken to reduce, eliminate, and prevent recurrence of We noncomplying discharge. <br />• b. The pecmittx shall report We following instances of noocomplimce orally within twenty-four (241 hours from the <br />time We permittce becomes aware of the noawmplieace, and shall mail to We Division a written report within five <br />(51 davs after becoming aware of We aoacomplimce: <br />1) Any instance of nonwmpiiance which may endanger hea1W or We mviroamenh <br />2) Any spill or discharge of oil or older substance which may cause pollution of We waters of We state. <br />c. The permittce shall report all other instances of noa~ompliance to We Division within 30 days. The reports shall <br />contain We information listed is sub-paragraph a. of this section. <br />4. Submission of Incorrect or Incomplete Wormation <br />Whets We perarittee failed to submit say relevent facts is a permit application, or submitted incorrect information in a <br />permit application or report to We Division, We pezmittce shall promptly submit We relevant application information which <br />was not submitted or any additional information needed to correct any erroneous information previously submitted. <br />5. (No determination made during <br />administrative review of claims that noncompliance was caused by upset, and before an action for noncompliance, <br />is final administrative action subject to judicial review.) <br />
