Page 2 of the Regular 113 Application Fornt indicates that minor quantities of lubricants and <br />other oil products will be used or stored a[ thz plant site for maintenance. In accordance with <br />Rules 3.L~(~j and 3.1.6(1), please provide an inventory of lubricants and oil products to be uszd <br />or stored on s'i[z and indicate what measures will be implemented to minimize putzntial impacts <br />to surface and/or groundwater from future leaks or spills of these materials. Also, please <br />describe whether fueling of equipment will take place on-sitz or off-site. If on-site, please <br />describe how and where the fueling operations will takz place. Finally, the Division rzcommends <br />that you provide a spill containment and countermeasures plan to address management of <br />possible leaks or spills of these materials. <br />15. As required by Rule 6.4.7(2)(c), please submit a brief statement or plan showing how water <br />from dewatering operations or from runoff from disturbed areas, piled material and operating <br />surfaces will be managed to protect against pollution of either surface or groundwater (and, <br />where applicable, control pollution in a manner that is consistent with water quality discharge <br />pemtits), both during and after the operation. ?, stormvvater management plan, if available, may <br />be submitted as part of this requirement. Also, the Division encourages you to consult with [he <br />Water Quality Control Division for permitting requirements regarding stormwater management <br />at the site. Please respond. <br />16. As required by Rule 6.4.7(3) please provide an estimate of the project water requirements <br />including flow rates and annual volumes for the development, mining and reclamation phases of <br />the project. <br />17. Rule 6.4.70) requires that the Operator/Applicant shall affirmatively state that the <br />Operator/Applicant has acquired (or has applied for) a National Pollutant Discharge Elimination <br />System (NPDES) permit from the Water Quality Control Division at the Colorado Department of <br />Health, if necessary. Pave 2 of Exhibit D - Ivlining Plan indicates that Groundwater will be <br />drained, then discharged from the site and a NPDES permit will be processed and obtained. <br />Therefore, prior to Division approval of the 1l2 application, the Division requests that CA:~{,4S <br />Colorado, Inc. provide a written statement that they have acquired or have applied for a NPDES <br />water discharge permit as required by the Water Quality Control Division. Please respond. <br />18. Review comments from the Office of the State Enginzer (OSE) pertaining to water rights and <br />permitting requirements are attached to this letter. In refzrence to Rule 6.=1.7(4), the Division will <br />require that CAMAS Colorado, Inc. provide written demonstration of compliance with all <br />permitting requirements of the Office of the Sate Engineer prior to exposure of groundwater at <br />thz Cooley Reservoir & Fulton Wildlife Area. Also, i[ is our undzrstanding that an application <br />for a water augmzntation plan for Cooley Reservoir should be fded with the OSE at least three <br />
