Pose <br /> <br />5. All parties received timely and suftcient notice of this hearing. The prehearing order is sufficient in all <br />respects and is hereby approved. <br />6. Mr. Sorenson testified about the application and the proposed operation. He testified that [he application is <br />complete and satisfies the standards and requirements of the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials, as well as the Board's Construction Materials Rules, provided that the <br />permit includes three specific conditions, identified below. He testified that the Division is satisfied that <br />Westem Mobile will successfully reclaim the disturbance associated with the proposed operation. <br />7. Ms. Goettemoeller testified [hat it is likely that the Applicant's reclamation plan will succeed. She testified <br />that Western Mobile is an experienced construction materials miner, and has reclaimed several sites in <br />exemplary fashion. <br />8. Since no objector appeared, the Board heard no controverting evidence. <br />F' <br />9. The Board concludes that Western Mobile has satisfied its burden of proof that the application complies <br />with § 34-32.5-1 l2, C.R.S. The evidence submitted by Mr. Sorenson and Ms. Goettemoeller demonstrates <br />that it is likely that Western Mobile's reclamation plan will succeed. <br />10. Therefore, the weight of the evidence supports the conclusion that the application complies with <br />§ 34-32.5-112, C.R.S. and should be granted. <br />
