AND ORDER <br />IN THE MATTER OF THE 112 CONSTRUCTION MATERL4LS PER1vHT APPLICATION OF <br />WESTERN MOBILE NORTHERN, INC., LOVELAND PIT, FILE NO. M-2000-034 <br />THIS MATTER came before the Mined Lands Reclamation Board on August 24, 2000 at Denver, <br />Colorado for the hearing of an application for a permit to mine construction materials, pursuant to <br />§ 34-32.5-112, C.R.S. Julie Goettemoeller, Senior Land Manager for Western Mobile, Inc. represented the <br />Applicant. Allen Sorenson of the Division of Minerals and Geology (Division) appeared in the capacity of staff <br />for the Board. The Board, having considered the application, the testimony and exhibits of the parties, and <br />having been otherwise fully informed in the premises, hereby finds and concludes as follows: <br />FINDINGS OF FACT AND CONCLUSIONS OF LAW <br />Western Mobile Northern, Inc. (Westem Mobile) has applied for a permit pursuant to § 34-32.5-112, C.R.S. <br />Westem Mobile proposes to operate a sand and gravel mine near Loveland, in Section 24, TSN, R69W, Larimer <br />County, Colorado. Western Mobile has applied fora 49.25 acre permit area. <br />The Division received timely objections from two parties and comments from the City of Loveland. <br />2. The Division held an informal conference on July 20, 2000 to define and attempt to resolve issues. One <br />objector appeared. <br />3. The Division has determined that the application complies with all requirements, and recommended its <br />approval with three conditions, which are identified below. <br />4. The Board's prehearing conference officer conducted a prehearing conference on August 7. <br />The applicant and the Division attended. No objector appeared. The prehearing conference <br />officer prepazed a prehearing order identifying the parties, the issues, the witnesses, exhibits <br />and order of procedure for the hearing, as well as the sole issue: Is it likely that Western <br />Mobile's reclamation plan will succeed? <br />
