The operator does not consider the area to be a <br />jurisdictional wetland due to the influence of irrigation water. The azea in question does <br />not fall within the next 5 years of mining, is not transected by access roads and will be <br />tested to determine if i[ is a jurisdiction wetland prior to disturbance. <br />Exhibit M -Other Permits and Licenses <br />26. Please be aware that additional permitting may be required, such as a stonnwater <br />discharge permit through the Colorado Department of Public Health and Environment. <br />Though notified of this application by our office, the applicant is encouraged to contact <br />the State Historic Preservation Office to verify that no significant cultural resources exist <br />on the proposed excavation site. <br />No response required. <br />Exhibit S -Permanent Man Made Structures <br />27. A[L permanent mate-made structures on or within 200 feet of the affected area boundary <br />must be adequately addressed as required by Rule 6.4.19. The definition of a permanent <br />man-made structure can be found in Rule 1.1 (48). <br />Damage waivers for the Gurley Ditch and the San Miguel Power Association powerline <br />can be found in Exhibit S. The access point on the Redvale Road will be installed per a <br />commercial driveway access permit issued by Montrose County and the use of Redvale <br />Road will be controlled by a Montrose County Special Use Permit. <br />
