RECITALS
A. The Permittse, Las Animas County, desires to cmduct a mining operatim (mown az Sandoval
Land and Cattle Pit, for the purpose of erdractmg sand and gravel. The Penrriltee will not mine any secondary
commodities.
B. On May 17, 2001 the Mined Land Reclarnatim Board (the "Board") approved the Pennittee's
apphcatim for this pertnrt and directed that this permit be issued upm the filing with the Divisim of Minerals and
Geology (the "Divisim") of performance warranty approved by the Divisiod. Said varranty has been Sled wGh
the Divisim.
C. hsthe Permittae desires to e>Arad materials dher than those listed ur (A), a separate permit may
be required.
D. OD May 17, 2001 the Board made the following Endings:
1. The applicatim for this permit complies with the requiremarts of the Colorado Mined
Land Reclamatim Act for the E>aractim of Construdim Materials, C.RS. 3432.5-101 et sue., az arrrended, and
with all applicable local, state and federal laws;
2. The operatim will not adversely affect the stabiGry of any signiScant, valuable, and
pemranem man-made structure located within two hundred feet of the Affected Land, except where there is an
agreement between the Operator and the persons having as interest in the strudrrre that damage ro the structure is
to be corrq~arsated fior by the PennAtee; and;
