DMG Response -The Division is not the permitting authority for air emissions. The Applicant has <br />committed to secure all appropriate air permits as required by the Air Quality Control Division, Colorado <br />Department of Health. The Applicant has provided "Best Management Practices" that will be employed <br />prior to and during blasting activities in order to minimize the generation of fugitive dust on site. <br />9. Has the Applicant provided adequate plans for sediment & erosion control, management of stormwa[er <br />runoff, and minimization of potential water quality impacts to surface and groundwater resources within [he <br />affected land and surrounding azea including North Clear Creek, as required by Rule 3.1.6? <br />DMG Response - The Applicant has provided a comprehensive sediment and erosion control plan for the <br />site which addresses management of stormwater runoff, and minimizes the potential for impacts to surface <br />and groundwater quality and supply. The Applicant has committed to provide "As-Built Certifications" <br />from a certified registered professional engineer within 60 days of completion of all hydraulic structures <br />and verify that all such structures were properly installed according to the designs provided in the mining <br />and reclamation permit. The Applicant has also committed to conducting an annual survey and <br />maintenance of all drainage structures. The Applicant has committed to securing an appropriate Colorado <br />Discharge Permit System (CDPS) from the Colorado Water Quality Control Commission prior to any <br />discharge offsite, and to securing a well permit or other permit as requved by the Office of the State <br />Engineer prior to exposure of groundwater at the site. Further, the Applicant has committed to backfill <br />within 24 hours any exposed groundwater to a depth of at least two (2) feet where quarry activities have <br />intercepted the groundwater surface, in the absence of an approved permit for exposure of groundwater as <br />required by the Office of the State Engineer. (The two (2) feet of cover requirement is standazd practice for <br />all constmction material sites that have potential ro intercept the groundwater surface during excavation). <br />10. Has the Applicant demonstrated compliance with applicable Colorado water laws and regulations <br />governing injury to existing water rights, as required by Rule 3.1.6(1)? <br />DMG Response -The Applicant has committed to securing a well permit or other permit as required by <br />the Office of the State Engineer prior to exposure of groundwater at the site. Further, the Applicant has <br />committed to backfill immediately any exposed groundwater with at least two (2) feet of soil material in the <br />absence of an approved permit for exposure of groundwater as requred by the Office of the State Engineer. <br />11. Has the Applicant submitted an adequate reclamation plan to achieve the postattining land use of <br />"wildlife habitat", as required by Rules 3.1.10 and 6.4.5? Specifically, with respect to re-vegetation and <br />noxious weed control. <br />DMG Response -The Applicant has provided a re-vegetation plan that meets the requirements of Rules <br />6.4.5 and 3.1.10 and is designed to facilitate reclamation to wildlife habitat. The Applicant's re-vegetation <br />plan specifies measures for establishment of grasses, shrubs, and trees. <br />12. Has the Applicant provided an adequate estimate of the reclamation cost required to complete the <br />reclamation plan and achieve the desued post-muting land use of wildlife habitat, as required by Rule <br />6.4.12? Specifically, with respect [o re-vegetation cost. <br />DMG Response - The Applicant has provided an adequate estimate of the reclamation cost required to <br />reclaim 39.28 acres of affected land to wildlife habitat, and has provided itemized costs for seedbed <br />preparation, re-vegetation with a gross mix, and re-establishment of shmbs and trees via tree and shrub <br />transplants. <br />13. Has the Applicant provided an adequate demonstration of vegetation resources, including wetlands, as <br />required by Rule 6.4.10? <br />
