ISSUES RAISED BY OBJECTORS: <br />Issues raised by objecting parties are listed below. The Division's response to objection issues follows. <br />Issues aze listed under the application exhibit secfion and/or rnle to which they pertain. <br />ISSUES WITHIN THE JURISDICTION OF THE DIVISION AND BOARD <br />Issues Raised Durine The Public Commeut Period <br />1. Has the Applicant submitted a complete application with respect to an accurate legal description of the <br />pernrit area, including correct latitude and longitudinal coordinates of the quarry access point from <br />Highway 119, and an accurate listing of contiguous property owners as required by Rule 6.4.1? <br />Specifically, with respect to I.L. & L.M. Turner. <br />DMG Response -The Applicant has submitted a complete application with accurate legal description of <br />the permit azea and has provided an accurate listing of the contiguous property owners, including LL. & <br />L.M. Ttrner. The original Exhibit C-1 has been corrected based on new information provided by Mrs. & <br />Mrs. Turner and updated records available in the Gilpin County Assessors Office. It appears that several <br />records for the azea have been updated since the initial preparation of Exhibit C-1 and the Regular 112 <br />Application. <br />2. Has the Applicant complied with the public notice procedures as required by Rules 1.6.2, 1.6.5, & 1.6.6 <br />including publishing a notice in a newspaper of local circulation and notifying neazby residents, as required <br />by Rules 1.6.2(1)(d)&(e)? <br />DMG Response -The Applicant has completed all public notice requirements as specified in Rules 1.6.2, <br />1.6.5, & 1.6.6 and has published all required legal notices in the appropriate newspaper of local crculation. <br />3. Has [he Applicant adequately demonstrated their source of legal right to enter [o conduct the proposed <br />mining and reclamation operation, as required per Rule 6.4.14? Specifically, "the proposed operation <br />cannot be conducted on the described property without proofoflegal access to the mining site, via a <br />grading permit issued by Gilpin County. " <br />DMG Response - Proof of legal access to the site, as required by Rule 6.4.14, was provided at the time of <br />application submittal and assures the Applicant has legal right to enter the proposed affected land for the <br />purposes of the Constmction Materials Act. Issuance of a grading pernil[ is a local permitting issue, not a <br />legal right [o enter issue. (See response to issue No. 4 below). <br />
