(herein Kauffman's), we aze supplying you <br />with the following information in response to your adequacy review of the above mentioned <br />permit application. Our replies are in the same order as your comments. <br />Rule 1.6.5(2) Attached is the proof of publication of the public notice circulated in the <br />local newspaper, and the proof of notification of all owners of record of surface lands that <br />are within 200 feet of the boundary of the affected land. <br />2. Rule 6.4.3 The scale of the map should have been noted as 1 "=300'. This has been <br />revised on the map. <br />Rule 6.4.3(g) The Boyd Lake Outlet Ditch property is owned by Kauffman's, the <br />property owner of the western half of the permit area. The fence lines surrounding Phase <br />1 are owned by the Flying W Ranch, property owners of Phase I, as indicated on the map. <br />There are no interior fence lines on the Kauffman's property. The overhead powerline to <br />the northwest of the permit azea is owned by Department of Energy, Western Area Power <br />Administration. Their address is P.O. Box 3700, Loveland, CO, 80539-3003. This <br />powerline is 200 feet from the permit boundary. <br />Rule 6.4.5(2)(d) Topsoil will be stripped and stockpiled separately from the overburden. <br />Topsoil in Phase I is approximately 6" to 12" in depth. All topsoil from this phase will be <br />stockpiled azound the perimeter of the mining limits and at the front edge of the <br />backfilled area (which will be continually moving towazd the west). Topsoil stockpiles <br />which remain in place longer than one year will be seeded with a fast growing cover crop <br />to protect from wind and water erosion. All topsoil stripped from Phase I will be <br />replaced in Phase I.
