Exhibit I -Soils Information <br />32. This exhibit mentions that the soil thickness information was obtained through examination of <br />boreholes drilled by fhe applicant in 2004. Please be aware that such activities require a Notice <br />of Intent (NOI) application to conduct prospecting. Any future activity as described, conducted <br />without an approved NOI may be subject to enforcement action for prospecting without a permit. <br />Exhibit J - Veoetation Information <br />33. Please specify the carrying capacity for livestock for rangeland in the vicinity of the pit. <br />Exhibit L -Reclamation Costs <br />34. Please add a dewatering task to the estimate. <br />35. This exhibit specifies that a peninsula will be constructed in Phase 10, but the Exhibit F map <br />shows a peninsula in Phase 11, not 10. Please correct this discrepancy. <br />36. Please revise topsoil replacement calculations based on increased replacement thickness as <br />specified in item no. 10 above. <br />37. Please evaluate reclamation costs just after phase 9 is mined out. This results in .5:1 slopes for a <br />length of 3200 feet across the north side of phases 10,11,and 12, plus along the east side of <br />phase 9. Reducing these slopes to 3:1, as described in the reclamation plan would require over <br />123,000 cubic yards(38,080 cut and fill to 2:1, 85,440 fill from 2:1 to 3:1 ). At this point al of that <br />slope and the affected area in phase 12 would require revegetation. <br />38. Please provide construction specifications for the shop and all other non-portable structures that <br />will require demolition and disposal. <br />Exhibit N - Rioht of Entry <br />39. This right of entry must have a notarized signature of the landowner as required by Rule 6.4.14 <br />by referral to Rule 6,3.7. <br />Exhibit O -Owners of Affected Land <br />40. Please revise this exhibit to include the landowners affected by the access road location and the <br />discharge ditch improvement location. <br />Exhibit Qand R -Notices to County Commissioners and Soil Conservation District and Placement With <br />County Clerk and Recorder <br />41. New notices and placement with clerk will be necessary for the amendment to the application. <br />Exhibit S -Permanent Man-made Structures <br />42. It appears that there are grain bins and ditches on the Hutchins property that are within 200 feet <br />of the affected area and need to be added to the list of structures. The Damage Waiver <br />Agreement for this property was signed by Will Hutchins. The landowner is stated to be Anna <br />Marie Hutchins. Therefore, the agreement must be signed by Anna Marie Hutchins. <br />
