PART II <br />Page 15 <br />Permit NO. COR-040000 <br />A. MANAGEMENT REQUIItEDRENTS (cont.) <br />Any discharge to the waters of the State from a point source other they specifically authorized by this permit is prohibited. <br />The Division must be notified in writing on the addition of any outfalls. <br />2. Saedal Notifications -Definitions <br />a. Spill: Aa vnintentioaal release of solid or liquid material which may cause pollution of state waters. <br />6. Upset: An exceptional incideac in which there is unintentional end temporary noncompliance with permit effluent <br />limitations because of factors beyond the reasonable control of the permittee. An upset does not include <br />noncompliance to the extent caused by operstioaal error, improperly designed treatment facilities, inadequate <br />treatment facilities, lack of preventative maintenance, or careless or ituptoper operation. <br />3. Nonwmoliance Notification <br />a: l$ for any mason, the permittee does not comply with or will be unable to wmply with any discharge limitations, <br />standards or permit requirements specified in this permit, the permittce shall, az a minimum, provide the Water <br />Quality Control Division and EPA with the following information: <br />1) A description of the discharge end cause of noncompliance; <br />2) The period of noncompliance, including exact dates and times and/or the anticipated time whey the discharge <br />will return to compliance; and <br />3) Steps being taken to reduce, eliminate, and prevent recurrence of the noncomplying discharge. <br />b. The permittce shall report the following instances of noncompliance orally within twenty-four t24) hours from the <br />time the permittee becomes aware of the noncompliance, and shall mail to the Division a written report within five <br />da s after becoming aware of the noncompliance: <br />1) Any instance of noncompliance which may endanger health or the environment; <br />2) Any spill or discharge of oil or other substance which may cause pollution of the waters of the state. <br />c. The permittee shall report all other instances of noncompliance to the Division within 30 days. The reports shall <br />contain the information listed in sub-paragraph a. of this section. <br />4. Submission of Lcorrect or Incomplete Information <br />Where the permittee failed to submit any relevant facts in a permit application, or submitted incorrect information in a <br />permit application or repoR to the Division, the permittce shall promptly submit the retevaat application information which <br />wes not submitted or any additional information needed w correct any erroneous information previously submitted. <br />5. Brag <br />The bypass of treatment facilities is generally prohibited. <br />6. Upsets <br />a. Effect of as Upset <br />• Ao upset constitutes m affvmative defense to as action brought for noncompliance with permit limitations and <br />requirem~ta if the requirements of paragraph b of this section are met. (No der~~~~tioa made during <br />adminishadve review of claims thaz noncompliance was caused by upset, and before an action for noncompliance, <br />is fmal ,+~t,ni~+ rive action subject to judicial review.) <br />
