Exhibit M -Other Permits
14. Please ensure all required county zoning and land use permits have been applied for or have
been obtained.
Exhibit N -Legal Right to Enter
15. Please verify that the current pipe in place at the proposed access road crossing of the Gurley
Ditch is sized as specified in the access road agreement signed by Mark Ragsdale, President of
Farmers Water Development Company. This pipe was constructed by welding several tanks
end to end and cutting a hole through the end pieces. The holes were not cut to the inside
diameter of the tanks, but left an estimated 4-5 inch lip at each joint. Therefore this diameter
measurement must be made at the inside of the smallest lip created by the cutting of the holes.
Exhibit S -Permanent Man-made Structures
16. Please include all additional structures identified in the Exhibit C portion of this letter and
provide adequate damage waiver agreements for those structures or adequate engineering
demonstrations of stability for those structures. Please include the County Road in the list of
structures to be addressed by this Exhibit.
17.The engineering exhibit for the DeJohn fence is inadequate. It must be a demonstration, not
just a statement of stability. Please provide adequate calculations and specifications that
demonstrate the stability of the proposed excavation slopes along the DeJohn fence and any
other applicable structures for which a damage waiver agreement is not secured.
Please be aware that previous correspondence has used the Permit No. M-2002-049 when this
application has been assigned the file no. of M-2002-094. Please correct your records accordingly.
If you need additional information, please contact me at the Division of Minerals and Geology,
Grand Junction Field Office, 101 South Third Street, Room 301, Grand Junction, Colorado 81501,
telephone no. 970-243-6368.
Sincerely,
_~~~~~
Steve S.
