Exhibit D -Mining Plan <br />5. The commitment to chip seal the portion of County Road 37.00 from the access road to <br />Highway 145 is not an issue under this Division's jurisdiction and will not be considered a part <br />of this permit. This text should be removed from the Mining Plan. <br />6. Please specify how any overburden encountered during mining will be handled, stockpiled and <br />separated from topsoil resources. <br />7. Please commit to leaving a minimum 2 foot thickness of porous material over the underlying <br />shale lens and under the replaced topsoil. This provides for drainage of any intercepted <br />stormwater and for a rooting zone for establishing revegetation during reclamation. <br />8. Please be aware that any sub-surface water leakage from Gurley Ditch is considered to be <br />groundwater and may not be exposed during mining activities without first obtaining a well <br />permit. <br />Exhibit F -Reclamation Plan Map <br />9. Topsoil stockpile berms as described will not hold the volume of topsoil required to replace a <br />depth of 6 inches over 15 acres. Please specify where additional topsoil will be stockpiled and <br />illustrate that on the Reclamation Plan Map. <br />Exhibit G -Water Information <br />10. Please indicate how the concerns of the State Engineer's Office, expressed in their letter dated <br />August 27, 2002, will be addressed. <br />Exhibit H -Wildlife Information <br />11 .Please indicatye how the concerns of the Colorado Division of Wildlife, expressed in their letter <br />dated September 24, 2002, will be addressed. <br />Exhibit J -Vegetation Information <br />12.Please include a spring application of herbicide, for control of Russian Knapweed, in the <br />proposed weed control plan. <br />Exhibit L -Reclamation Costs <br />13.A reclamation cost estimate will be calculated by DMG in the next few days. The estimate will <br />include backfilling of 2 - 300 foot long highwall "wings" and cut and fill reduction of the 1200 <br />foot long advancing highwall face. <br />
