I have several questions and comments <br />that I would normally organize in this letter on an exhibit-by-exhibit <br />basis. However, due to the Board's decision concerning your civil penalty, <br />I feel that we must try to expedite this procedure as much as possible. <br />Therefore, I have enclosed a copy. of an application work sheet that our <br />staff is developing. Please read this document carefully, fill it out <br />and return it to our Division as soon as possible. This should go much <br />of the way toward making this application adequate. <br />I urge you to contact the Division of Wildlife, the Soil Conservation <br />Service and Conejos County immediately. If you have already done this, <br />I suggest that you follow up on this closely. Their inputs are necessary <br />to make your application adequate for Board consideration during the <br />March 24-25, 1982 meeting. If you miss this meeting, the existing ruling <br />of the Board would make you liable for the full $10,000.00 civil penalty. <br />I would also like to make a few comments about the application form itself. <br />First, the county designation under item 11 is incorrect. The pit is <br />just over the line in Conejos County. You should make sure of this and <br />contact the appropriate county officials, as well as placing a copy of <br />this application with the correct county clerk's office. Second, the <br />acreage for a limited impact permit must be under 10 acres. An area' <br />900' x 900' is 18.6 acres in extent. Pty estimation of the present <br />disturbed acreage was under 10 acres. If you wish to expand this limited <br />impact permit later, you may do so after 2 years by converting it to a <br />regular permit.
