<br />Exhibit S -Significant Man-made Structures <br />Please see attached LPEA comments regarding road under power lines. After providing <br />additional information to LPEA, they have provided the requirements for constructing the <br />road under their power lines. AGRI-DLD has agreed to LPEA's requirements for <br />construction of the road, and will coordinate with LPEA prior to and during construction <br />of the road. Please see revised Exhibits D, C, and F. The road will remain for post <br />mining use. Please see attached notarized damage agreement. <br />The private road through Phase 7 is wholly owned by the landowner, AGRI-DLD, LLC. <br />Additional Items <br />Please see attached proof of mailings for Anthony Zelletti & Marilyn Barry, and Dorthy <br />Leidy. <br />This letter and all revisions and attachments have been place on file for public viewing <br />with the La Plata County clerk and recorder's office, please see attached receipt.
