c. This permit does not grant exclusive use of [he land
described, and the permit area shall be available for other
surface uses, including livestock grazing, where compatible
with operations conducted ~y the permittee. This permit is
subject to all leases now in effect on said land, and the
permittee is to cooperate with, and not to interfere with,
nor prevent the operations of the lessees. In all cases
this permit is subject to any rights-of-way heretofore
granted and now in effect. Coal lessee shall not be
responsible for any damages to wells if mining should
occur. This permit shall be cancelled upon written notice
to [he permittee iE coal lessee should require these lands
for its mining operations relative to a lease on this land.
d. The permittee is to provide drainage and erosion control
structures, fences, gates, cattlequards, o[ any other
facilities necessary to protect state land.
e. Drill 'poles, excavations, and improvements shall be
maintained in a safe condition to prevent injury to
persons, livestock and wildlife.
f. All operations of the permittee shall be conducted in a
workmanlike and reasonable manner, and all necessary
precautions shall be taken to avoid any damage to the state
land or the property of the lessee. Any damage done to the
state's property, native grass or timber, or state-owned
improvements, shall be paid for to the state. Damage to
private property including fences, crops, irrigation
structures, wells, livestock and privately-owned
improvements, shall be paid for to the owner [hereof.
g. To the extent authorized by law, the permittee shall
indemnify, save and hold harmless the Board of Land
Commissioners, its employees and agents, against any and
all claims, damages, liability and court awards including
costs, expenses and attorney fees incurred as a result of
any act or omission by the permittee, or its employees,
agents, subcontractors o[ assignees pursuant to Che teems
of [his permit.
h. This permit does not grant the use of water from said
premises, either from flowing streams or from wells unless
specifically authorized by Che Board in writing. Normal
sampling of the monitoring well shall not be considered as
a violation of this condition, however any permitting
requited by the laws of the state shall be filed in the
name of the state through the Board.
i. No refuse, waste or litter of any Kind shall be Left on the
land. The permittee shall comply with all federal and
state laws, regulations and standards relating to air,
water, land and noise pollution.
