Compliance With Terms and Conditions of Previous Permit <br />1. Effluent Limitations: The data shown in the preceding tables indicate that the Twenrymile Coal Company facility <br />has maintained compliance with the previous permit with the exception of the fo[[owing.• <br />Outfa11001: I pH, 2 rota! recoverable iron exceedences; <br />Ourfall 002: 5 BODs, 5 BODs % removal, 1 TSS, 1 fecal coliform exceedences. <br />The perminee explained each exceedence in writing and described actions taken to correct them. Because these <br />exceedences occurred over atwo-year period and the permittee responded quickly each rime, no formal <br />enforcement action has been taken. <br />2. Other Permit Requirements: The permittee has been in apparent compliance with al[ other terms and conditions <br />of the permit. <br />V. TERMS AND CONDITIONS OF PERMIT <br />A. Determination of Effluent Limitations <br /> <br /> <br />• I. Effluent Limitations: In developing suitable effluent limitations, the Division must review a[[ applicable <br />standards and regulations and apply those which are more stringent. This review includes, but is not limited <br />to.• the water quality standard based effluent limitations, federal guidelines and standards (40 CFR Subchapter <br />N) and the Regulations for Effluent Limitations (Regulation No. 62). Such a review has been done for this <br />facility. The only parameters for which limitations have been determined !o be necessary are shown in Tables <br />V-I and V-2 with the applicable limitations.
