<br />LAND STATUS AS OF 7/25/89 <br />Map Exhibit B-3 shows the surface and subsurface ownership of <br />the coal lands included in the Meeker Project as it existed on <br />January 4, 1985. it encompassed 3,956.85 acres of private <br />lands and 765.5 acres of coal land from the U.S.A. On October <br />31, 1986, the private fee coal lease was terminated, and Enron <br />Coal Company entered into an easement for reclamation purposes <br />to enter the surface. (See the Easement attached hereto.) On <br />April 27, 1987, the U.S. coal leases were relinquished to the <br />U.S.A. (See the letter decision of the Bureau of Land <br />Management, Department of the interior, attached hereto.) On <br />June 8, 1989, Applicant and Enron Minerals Company mailed to <br />the BLM an application and notice to relinquish the PRLA's, a <br />copy of which is also attached hereto. Applicant retains <br />surface rights to enter the premises for the purpose of <br />reclaiming the same pursuant to its reclamation easement and <br />surface patents pursuant to the federal lease language granting <br />exclusive rights of entry and use of the surface for reclama- <br />• tion purposes subject to the U.S.A. Mineral Leasing Act of <br />1920, as amended. Such surface rights are adequate for <br />Applicant to complete its reclamation obligations as set forth <br />in this permit. <br />r ~ <br />U <br />Q~a.3 R 7 f~5~8`~ <br />
