3.2 WRTTTEN CONSENT FROM SURFACE AND SUBSURFACE OWNERS <br />For underground mining activities where the associated surface opera- <br />tions involve the surface mining of coal and the private mineral estate to <br />be mined has been severed from the private surface estate, the appli- <br />S cation shall also provide for lands to be affected by those operations <br />~ within the permit azea - <br />(1) A copy of the written consent of the surface owner to the extraction <br />of coal by surface mining methods; or <br />(2) A copy o[ the document of conveyance that expressly greats or <br />reeerves the right to extract the coal by surface mining methods; or <br />(31 If the conveyance does not expressly grant the right to extract coal <br />by surface mining methods, documentation that ~mder the applicable <br />State law, the applicant has the legal authority to extract the coal by <br />those methods. <br />( Not applicable for the reason that applicant's underground mining <br />activities will not involve the actual surface mining of coal Applicant would <br />further state that Sts right to conduct underground mining operations and to use the <br />i <br />overlying surface as reasonably necessary to conduct such operations is based on the <br />' aforementioned coal leases snd surface lease idmtltied la Section 782.15 (a) above. <br /> <br />-~ <br />~~~1gq <br />~I~1$? <br />
