When all mining has been completed <br />on the lands described in exhibits "B", "C-1", and "C-2", then <br />Lakewood further agrees to grant or otherwise assure Robco a <br />sixty (60) foot road easement for access from the northerly <br />portion of the property described in exhibit "C-1" to West <br />Alameda Parkway, directly or indirectly, at a place to be mutually <br />agreed to by Robco and Lakewood. <br />Lakewood, agrees to provide the Colorado Mined Land <br />Reclamation Board with written confirmation that the lands <br />_ .r~~ <br />described in exhibits "B", "C-1", and "C-2" may be used for / <br />- mining as requested by Robco in an amended mining permit appli- V <br />cation or revisions, agreeing that r.a__kg_wond shall have the might <br />to review and render its opinion on such amended application or <br />revisions yrior to the issu~an`ce of a permit by the Dlined Land <br />i ~~, <br />Reclamation Board. <br />5. Robco acknowledges that Alameda Parkway may be <br />widened in the future and agrees that it will leave an average <br />setback of fifty (50} feet between the southern edge of the <br />Alameda right-of-way and the area upon which mining or reclamation <br />activity occurs in order to assure proper stabilization of the <br />future roadway.. The specific setback line shall be established <br />in the amended mining permit application, to be reviecved by <br />Lakewood, and shown as the affected land boundary. <br />6. CLOSING: Closing on this Agreement and conveyance <br />of the mineral interests and rights described herein by general <br />warranty deed shall occur on or before August 1, 1983. <br />7. GENERAL PROVISIOtdS: <br />a} This constitutes the entire Agreement between <br />the parties. Any amendments to this Agreement shall be in writing <br />and executed by both parties. <br />b) This Agreement shall be governed and construed <br />according to the laws of the State of Colorado, ar~d venue for <br />any proceedings or actions under this Agreement shall be in the <br />District Court of Jefferson County, Colorado. <br />-3- <br />
