<br />interests, and to include contiguous lands to the south of the <br />land owned by Lakewood, currently owned or leased by Robco; and, <br />WHEREAS, Lakewood is desirous of better defining the <br />areas of mining of clay and silica sand by Robco and therefore <br />to permit better utilization of the remaining lands owned by <br />Lakewood; and, <br />WHEREAS, it is the desire of both Lakewood and Robco <br />to resolve all disputes and differences regarding the use of <br />said lands. <br />NO-7, THEREFORE, in consideration of the above recitals <br />and the covenants and promises hereinafter set forth, the parties <br />covenant and agree as follows: <br />i. Robco shall com~ey to Lakewood its mineral interests <br />and rights as currently owned within and upon said real estate <br />described in exhibit "A" save and except that portion of real <br />estate described in exhibit "B" attached hereto and made a part <br />hereof. The mineral interests currently o~•~ned by Robco in and <br />upon the real estate described in exhibit "B" shall be retained <br />by Robco until, in Robco's sole discretion, all mining of clay <br />and silica sand has been completed on said real estate by Robco <br />at which time the mineral interests and rights on said land <br />shall be conveyed to Lakewood. <br />2. Robco shall release its clay and silica sand leases <br />aforedescribed upon the land owned by Lakewood as described in <br />exhibit "A", save and except that real estate described in <br />exhibit "B". The lease interest owned by Robco in and upon the <br />lands described in exhibit "B" shall be retained by Robco until, <br />in Robco's sole discretion, all mining of clay and silica sand <br />has been completed upon said real estate by Robco at which time <br />the lease interest retained by Robco shall then be conveyed to <br />Lakewood. <br />3. Lakewood recognizes that Robco is currently mining <br />clay and silica sand on the lands described in exhibit "B", and <br />on real estate described in exhibits "C-1" and "C-2", attached <br />-2- <br />
