WESTERN RAILROAD C ~IPANY, a corp anon of the State of~Delaware,
(hereinafter calla "Licensor" , party of the first par[,. and LEONARD
H. }tARVEY, JA1!ES C. t and LEONARD J. HARVEY, of Parkdale, Colorado,
(hereinafter called '!Licensees"), parties of the second part,
WITNESSETN:
RECITALS:
' The Licensees own certain land at Parlcdale, Colorado which
lice north of and adjacent to the main line tracks and right of way
of •the Liceneor'e Royal Gorge Route. U. S. Highway No. 50 parallels
and lies approximately 200 yards south of the said tracks and right
of way of the'Licenaor at Parlcdale. The Licensees' land is reeehed
Eras U. S. Highway 50 by means of a private road which extends north
fray said highway and crosses the said tracks and right of way nt a
point approximately 350 feet west of the Licensor's depot building at
Parkdale.
The Licensor owns and maintains a steel end masonry underpass
underneath its trac!cs at Parkdale, Colorado, et a point approximately
500 feet east of its said depot building, and the Licenseec desire per-
mieeion from the Licensor to drive over and across certain land of.the
Licensor at Parkdale, .lying south of said trac!ce and right of vey, and
through said underpaae during times when the aforesaid railroad cross-
~ing is blocked by Licenaor.'e trains.' The Licensor is willing to grant
.such permission to the Licensees upon the terms and conditions herein-
after set forth.
ACREEPIENT
NOW, THEREFORE, it is mutually agreed by and betveen the
parties hereto as follows:
Section 1. In consideration of the sum of Ten Lollare ($10.00)
to be paid by [he Licensees to the Licensor upon Che execution and •de-
livery of this agreement, and in furth¢r consideration of the covenants
and agreanen[a herein set out [o be by the Licensees kept, observed and
performed, the Licensor hereby grants to the Licensees, subject to the
terms end eonditione herein stated, permission during the continuance
of this agreement for the Licanaees, the members of their fsmilfea and
the Licensees' employees to drive their vehicles over and across the
land of the Licensor at Parkdale, Colorado, in the locations shown by
yellow lines on the print attached hereto marked Exhibit A and hereby
made a part hereof, and through the aforesaid underpaae of the Licensor
at Parkdale, Colorado in the location shoun by a green line on said
Exhibit A, solely during such times as the railroad crossing referred
to in the Recitals hereof is blocked by the trains of the Licensor.
The roadway eztendiny through aforesaid underpaae in the
location shoun by green line on said Hxhibit A and the said premises
of the Lieeneor at Parkdale, Colorado, shown by yellow lines on~8zhlbit
A, are hereinafter aomatimes collectively called the "Lieenaed Premises".
