All technical adequacy concerns were found to be satisfied. Also, the Division <br />is in agreement with a reclamation cost of $9,400. The only concern to be resolved on or before <br />the Apri127, 2000 decision date is to determine acceptable form of performance and financial <br />warranty, given the administrative constraints of the U.S. Forest Service. The Division will be <br />consulting with a representative of the Colorado Attorney General's Office and will respond <br />promptly with our request for how the warranty issue may be satisfied. Following issuance of <br />Permit No. M-2000-040, the existing Special 1 I 1 Operation Permit M-92-088 will be terminated <br />and the financial warranty provided by Duckels Construction, Inc. for such permit will be <br />returned.
