BEFORE THE MINED LAND RECLAMATION BOARD STATE OF COLORADO F[NDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER IN THE MATTER OF POUDRE TECH AGGREGATE, INC., THE STEGNER FARMS MINE SITE, FILE NO. M-99-021, APPROVAL OF A 112 PERMIT APPLICATION OVER OBJECTIONS THIS MATTER having come before the Mined Land Reclamation Board ("the Board") on July 27, 1999, for a hearing. [he Board makes the following Findings of Fact and Conclusions of Law, and enters the following Order: FINDINGS OF FACT AND CONCLUSIONS OF LAW I. On March 1, 1999, Poudre Tech Aggregate, Inc., filed a I l2 Permit Application, File No. M-99-021, [o conduct a sand and gravel mining operation in Larimer County, Colorado, Sec. 33, T8N, R69W, 6th P.M. ' 2. Timely objections to the application ware received by the Division of Minerals and Geology ("Division"). An informal conference was h~;ld on May 6, 1999, in Fort Collins, Colorado, pursuant [o Construction Materials Rule 1.4.6(I)(b). The matter was scheduled for the July 27-28, 1999, Board hearings. 4. On July 2, 1999, the Division issued a recommendation to the Board to approve the permit application. 5. On July 16, 1999, aPre-hearing Conference was held in Denver, Colorado, to verify the list of parties and to narrow and distill the issues to be considered by the Board at the final hearing. Catherine Kraeger-Rovey presided as the Pre hearing Conference Officer designated by the Board. As a result of the Pre-hearing Conference, apse-hearing order was generated, listing the parties and outlining [he schedule and time allotments for presentations at the final hearing. 6. At the Pre-hearing Conference, Ms. Kraeger-Rovey determined that the issues to be considered by the Board at the Final Hearing were to consist of: • Effects on ground water quantity. • Adequacy of Reclamation Plan. These issues were listed in the pre-hearing order. The pre-hearing order was mailed to tl~e parties on July 20, 1999.
