The estimate will include dewatering costs for the pit. <br />EXHIBIT O -Proof of Notice to Soil Conservation District <br />23.Your response still indicates that the notice was delivered to the Mesa County Soil <br />Conservation Service. Please verify that this notice was actually received by the Mesa Soil <br />Conservation District. <br />EXHIBIT S -Permanent Man-made Structures <br />24.The Damage waiver agreement with Grand Valley Power was not signed by Martin Azcarraga. <br />Please re-submit a signed agreement. <br />The engineering demonstration is not adequate to demonstrate that the specified permanent <br />man-made structures will not be damaged by the mining operation. The engineering <br />demonstration must specify the maximum distance that a failure can occur at this site under <br />saturated conditions. Include a buffer zone around all structures, for which a damage waiver <br />agreement has not been submitted, that is adequate to ensure these structures will not be <br />damaged by the mining operation, should the potential maximum failure occur. <br />The Division is concerned about saline discharges to the Colorado River. However, the Colorado <br />Department of Public Health and Environment has jurisdiction over this matter.
