I
01/22/2002 12:33 7195376258
DAVID DANIEL
PAGE 07
3112 pitched roof which meets Courrty Building Codes and is certified as meeting the National
Manufactured Housing Construction and Safety Standards Act of ]974 (42 U.S.C. 5401 et seq.).
Such manufactured homes are a single family dwelling and may not, provided that their
construction is equivalent to that required by the county's building code, be excluded from any
location where asite-built single family dwelling would be permiried". Given this, Mr.
Rubeck's ]969 12 feet wide mobile home does not meet Park County's requirement for
permitted manufactured homes within Pazk County and would require an approved Conditional
Use Permit, which can be obtained from the Park County Planning Department.
Per the Park County Road and Bridge Department, Matukat Road (U. S. Forest Service Road
#211) is a public road and is Park County maintained. Given that, Park County maintains a 60
feet right of way. From the middle of the road, Park County right of way extends 30 feet toward
Walt Rubeck's mining claim. In theory, at that 30 feet point, Walt Rubeck's mining claim
begins. Per Park County Land Use Regulations, "All buildings shall be located at least fifty (50)
feet from the property lines". Any building closer than that fifty (50) feet setback would require
an approved Variance, which can be obtained from the Park County Planning Department.
If you would like to discuss any of these issues, please don't hesitate to contact me.
Respectfully yours
JCim Halt
Code Enforcemem Officer
Park County Government
Cc Walt Rubeck
Park County Attorney
Scott Bernhart, Director, Park County Planning Departmerrt
Tom Eisenman, Director, Park County Environmental Health Department
Page 2 of 2
