You will receive <br />a second letter to that effect prior to February 27, 1985. <br />The amended site plan is being submitted to the County and no <br />mining will take place until their approval is received. This <br />amended site plan is the same as the one enclosed with the added <br />County stipulations. <br />We see no reason for delay of State approval, therefore, we <br />regcest you proceed with this MLRB permit application. County <br />stipulations have no effect on the State MLRD approval process. <br />Exhibit P _ Adjacent Landowners <br />1. The Denver Water Board (Mr. Bob Panesi) was notified as <br />requested by Mr. George Garramone of the Denver City and <br />County Land Office because we were led to believe they had <br />some kind of right-of-way on site. This is not the case. <br />You will be receiving notification of approval to mine within <br />100 feet of the well and power lines which has been requested <br />from the Public Service Company. <br />2. The First National Bank of Denver was notified September 26, <br />1983 (we have receipt). Since then, the bank has changed <br />their location, name, and/or ownership four times. Per our <br />phone conversation with them, they have no idea who the <br />engineer is oc who to send notification to. They said they <br />received notification the first time and acknowledge that <br />mining will take place sometime in 1985 and no further <br />notification is necessary. <br />3. All landowners near the site were notified as a courtesy, as <br />shown on the map. Delbert Weidenhamer is not actually an <br />adjacent landowner as specified by State law, therefore, <br />receipt of notification is waived. <br />
